1. ENTIRE CONTRACT. This document contains the terms of sale. The entire contract between Seller and Buyer is contained in this order acknowledgement; no alleged oral promises or conditions not set forth herein shall be binding upon Seller or Buyer, and any prior negotiations between the parties are merged herein.

2. BILLING OF ORDER. This order will be billed automatically once purchased online or once confirmation has been made by email, telephone or ground mail. The invoice shall be due and payable upon receipt. Once you place an order on USASkiClub.com it will be processed once payment is received. The delivery date of your order will vary based on when payment is received and the date the order is placed.

3. RETURNS AND CANCELATIONS. Absolutely no returns or cancellations will be accepted after customer has received items.  If ordered items are delivered electronically, no refund or return will be accepted without explicit authorization and mutual agreement by USA Ski Club and buyer.

4. LIMITATION OF WARRANTY.  There are no warranties, expressed or implied, that extend beyond the description on the face hereof, including any implied warranty of merchantability or warranty of fitness for a particular purpose. However, seller warrants that the goods sold shall conform to the description and quantity specified. 

5. LIMITATION OF LIABILITY. USA Ski Club and or Cole Flournoy assume no liability for the purchase of items through usaskiclub.com including any physical injury and or death that occur relating partially or fully due to item(s) purchased from USA Ski Club and or Cole Flournoy.

6. LEGAL PROCEEDINGS. The parties agree that any legal proceeding brought to enforce the terms and conditions of this order acceptance shall be conducted in the appropriate court located in Virginia, USA . This order acceptance shall be governed by the laws of the State of Virginia, USA .
